Terms & Conditions – Homefit with Esther

These terms and conditions apply to all services offered by Homefit with Esther via the website and to all agreements between Homefit with Esther and the client.
2. Services and Communication
Homefit with Esther offers online fitness coaching. Communication and guidance are provided via:
- The chat function in the Everfit app
Video calls are only offered with the more expensive / 'Homefit Complete' subscription, unless otherwise agreed in writing.
3. Availability, Holidays, and Response Times
Homefit with Esther aims to respond to customer messages and questions within 24 hours on business days. No responses are provided on weekends or official Dutch public holidays; response times are resumed on the next business day.
Homefit with Esther reserves the right to take up to 20 vacation days per calendar year. During this period, response times may be longer or certain services temporarily unavailable. Clients are informed at least 7 days in advance of planned vacations.
4. Medical Disclaimer & Suitability
Homefit with Esther is not a doctor, physiotherapist, or medical specialist and does not provide medical advice. The client is responsible for assessing their own medical suitability to train. In case of doubt, a doctor should be consulted first. Homefit with Esther is not liable for injuries or health problems that (partly) result from performing exercises or following advice.
5. Results
Results (such as weight loss, muscle gain, or improved fitness) vary per person and cannot be guaranteed. Results also depend on the client's commitment, lifestyle, and medical circumstances.
6. Start Fee / Intake
Upon registration, the client pays a start and intake fee of €49,-. This fee covers the intake conversation, goal assessment, preparation of a personalized program, and administrative setup. The start fee is paid immediately upon registration and is non-refundable.
7. Subscription & Payment
The subscription starts on the 1st of the month after receipt of the start fee and first payment. The monthly fee is €145,- for Homefit Basic and €235,- for Homefit Complete.
Payment is made via SEPA direct debit. The client gives explicit consent by ticking the SEPA authorization in the registration form.
8. Cancellation
The notice period is 1 month. Cancellation must be done in writing via the chat function in the app or via the contact form on the website. After cancellation, the automatic debit stops at the end of the current notice period.
Cancellations made during an ongoing month do not result in a refund of payments already made.
9. Cooling-Off Period (Right of Withdrawal)
According to the Distance Selling Act, the client has a 14-day cooling-off period. However, once Homefit with Esther starts actively providing the service (e.g., creating a personalized plan, intake/analysis, or initiating contact in the app), the right of withdrawal for that service expires.
10. Use of Materials
All training plans, videos, PDFs, and other materials provided by Homefit with Esther remain the intellectual property of Homefit with Esther. The client may not copy, share, or use these materials commercially without explicit written permission.
11. Liability
Homefit with Esther is not liable for direct or indirect damages arising from participation in coaching or following advice. Liability is at all times limited to the amount paid by the client for the respective month.
12. Privacy & Data
Homefit with Esther processes personal data in accordance with the GDPR. Personal and health data are treated confidentially and used solely for providing coaching, communication, and billing. Data are not sold to third parties. For more information, see our Privacy Statement.
13. Changes and Availability
Homefit with Esther reserves the right to modify these terms and conditions. The most recent version is available on request or can be consulted via Terms & Conditions.
14. Applicable Law
This agreement is governed by Dutch law. Any disputes will be submitted to the competent court in the Netherlands.
15. Right of Exclusion / Cancellation by Homefit with Esther
Online Coaching:Homefit with Esther reserves the right to terminate a coaching agreement in case of inappropriate or disrespectful behavior by the client. In such cases, the subscription is terminated immediately and payments are not refunded. The intake/start fee remains non-refundable.
Weekend Retreats:Homefit with Esther reserves the right to cancel a participation in a weekend retreat if there is no suitable feeling about the participant or if the safety or comfort of the coach is in doubt. In such cases, the full amount paid for the retreat is refunded. Cancellations by Homefit with Esther are communicated in writing as soon as possible (email or phone).
16. Agreement
By agreeing to the payment and ticking the checkbox for Terms & Conditions, the client confirms that they have read, understood, and agreed to these terms.
